Permit life. Environmental management permits issued on or after January 15, 1990, shall expire 36 months after issuance unless otherwise specified in subsection (1)(a), or otherwise specified in subsection (1)c.

Extensions. Permits may be extended, by request of the applicant and approval of the director, for successive periods of time not to exceed 12 months each, provided the request is made prior to the expiration date.

Early expiration for cause. If no substantial and readily observable site development activity has taken place within 18 months of the issuance of the permit or, once development is started, if no such development activity occurs for any 12 consecutive months, the director may determine the permit to be expired and shall so notify the permittee.

Phased development permits. The director may extend the expiration period of the initial permit for a phased development project to minimize continual re-administration of identical permits, provided that the master development plan filed for the original permit is definite with regard to location of infrastructure, land use categories, roadways, and other significant plan elements for all phases of development.

Effect of permit expiration. Once a permit has expired, no further development activity may proceed on the permitted development site unless and until a new permit application has been submitted and approved for the particular development site and activity.
