AMENDMENTS/RE-SUBMITTAL/EXTENSIONS

PERMIT AMENDMENTS - Sec. 10-4.215

  1. Scope. A request for any minor change to plans approved for a permitted site shall be made as an application for amendment to the applicable permit under this article. Substantial changes, including significant increases in impervious area, changes in intended land use, modification of stormwater management systems, new phases of development, or other additions, shall not be treated as amendments, but shall require a new permit application.

  2. Forms. Amendment requests shall be submitted on either a standard form or a short form, the determination of which shall be based upon the same criteria as the original application. Additional information submitted with a request for permit amendment shall be adequate to fully document the nature of the proposed change and the effect it will have on all environmental aspects regulated by this article. All plans, reports, calculations, and other information affected by the proposed amendment shall be updated so as to maintain an accurate record of the development activity.

  3. Application Review. Review times and procedures for an application for amendment shall be the same as specified for the review of the standard or short form application, whichever is applicable.

PERMIT APPLICATION RE-SUBMITTAL

  1. Re-submittals. Re-submittals are reviewed by staff under the same time frame as required under the original permit application.

  2. Tree Removal Applications - 10-4.206
    Request for additional information shall be within 20 working days after receipt of the application. If the request is not complied with by the applicant within 14 calendar days, the application shall be deemed withdrawn.

  3. Re-submittal Fees 10-4.216(b)(1)
    A fee, in the amount established by the Board of County Commissioners by resolution, shall be paid at the time of the third and each subsequent re-submittal of any application as to which staff review and comments relating to the preceding submittal have indicated a need for additional information.

EXPIRATION OF PERMITS - Section 10-4.214

  1. Environmental management permits issued on or after January 15, 1990.

    1. Permit life. Environmental management permits issued on or after January 15, 1990, shall expire 36 months after issuance unless otherwise specified in subsection (1)(a), or otherwise specified in subsection (1)c.

    2. Extensions. Permits may be extended, by request of the applicant and approval of the director, for successive periods of time not to exceed 12 months each, provided the request is made prior to the expiration date.

    3. Early expiration for cause. If no substantial and readily observable site development activity has taken place within 18 months of the issuance of the permit or, once development is started, if no such development activity occurs for any 12 consecutive months, the director may determine the permit to be expired and shall so notify the permittee.

    4. Phased development permits. The director may extend the expiration period of the initial permit for a phased development project to minimize continual re-administration of identical permits, provided that the master development plan filed for the original permit is definite with regard to location of infrastructure, land use categories, roadways, and other significant plan elements for all phases of development.

    5. Effect of permit expiration. Once a permit has expired, no further development activity may proceed on the permitted development site unless and until a new permit application has been submitted and approved for the particular development site and activity.
